Abstract

This chapter seeks to place the provisions of Book Four of the Chinese Civil Code (hereinafter CCC), dealing with personality rights, into comparative perspective. It contrasts the systematic and comprehensive treatment of personality rights in the CCC with the piecemeal and haphazard development of personality rights protection in other countries. Following a comparative introduction, it focuses on the following specific features of the CCC provisions: the general approach taken, including allocation of these provisions to a separate book of the CCC, independent from the law of tort (Book Seven CCC); the definition and scope of ‘personality rights’ in the CCC; their means of protection; and the remedies provided for infringement.
