Abstract

This chapter provides an overview of the law governing treatment of eating difficulties in England and Wales. We focus on the law on consent and the Children Act 1989, Mental Capacity Act 2005 and Mental Health Act 2007. Together, these statutes regulate providing medical treatment for children and adults. The chapter outlines the processes which permit compulsory admission and treatment of eating difficulties. Notably, it includes the controversial treatment of naso-gastric feeding for critically underweight patients and use of restraint which some readers may find distressing to read. Emphasis will be placed on the legal safeguards and rights of persons who are experiencing eating difficulties.
