Abstract

When will environmental regulation generate a right to compensation by affected foreign investors? The position under customary international law is compared with that under article 1 of the First Protocol to the ECHR, and also with NAFTA Chapter 11,whose definition of investment has the potentially substantially to expand the scope of such claims.
