Abstract

Comments on Garib v Netherlands (43494/09) (ECtHR) on whether the refusal to grant the applicant a right to move to another property within the same inner city district was an unjustified interference with her right to choose her own residence under ECHR Protocol 4 art.2. Notes the dissenting views as to the impact of the relevant legislation on those with lower incomes and the court's failure to examine the measure under art.14.
